Qualified experiment

A qualified trial is a criminal offense when an attempted offense is still a culpable offense.

Example: someone shoots at another with the intention of killing him by a targeted shot on the head. The shot misses however the head and meets only the ear of the targeted person. Here, at least, an attempted manslaughter according to § 212, § 22 of the Penal Code. Furthermore, by the meeting of the ear the dangerous bodily injury according to § 223, § 224 Abs. 1 No. 2 Alt. 1 of the German Criminal Code (StGB). The manslaughter has been tried and the dangerous bodily injury has been completed, so a qualified attempt is made.

Not to be confused is the qualified test with the success-qualified test or the attempt to achieve success.
