A public offense is a criminal offense of the Austrian Criminal Code for certain forms of jointly acting or the peril of common perils.

A person who is negligently (§ 177) or deliberately (§ 176) is liable to a great extent for a body or a life (§ 89) of a larger number of people or for foreign property. The penalty is up to ten years in the case of intent; for negligence up to one year. In the event of a real risk, the corresponding penalties of § 169/3 (firefighting) shall apply in case of intent, as well as § 170/2 (negligent application of a conflagration) in case of negligence. An aggravation is the threat of death with death.

The following are expressly excluded from the general risk: the risk of fire or fires, nuclear energy or ionizing radiation and explosives which constitute their own circumstances.
