Empowered police

Article 21 of the Political Constitution of the United States of Mexico is timely in establishing that the investigative power corresponds to the Public Prosecutor's Office and to the Police - of any level of government - with two primary objectives: to investigate to prevent and prosecute the crime. As regards this latter function, the importance of Field Criminalistics in the investigative role of police officers is emphasized by providing them with new technical and scientific powers such as the processing of evidence found at the place of investigation.

Article 77, section VIII of the General Law of the National Public Security System of enforcement throughout the national territory, second the new functions of the so-called Facultad Police Units which once located the indications must carry out the processing of the the following phases: marking, fixing, lifting, packing and transfer to the laboratory with their respective chain of custody. Articles 123b of the Federal Code of Penal Procedures, 8th section XVII of the Federal Police Act, are uniform in recognizing the importance of having the first contact officer have the authority to safeguard the protection of the place of investigation as well as the evidentiary material that constitute the cornerstone for the establishment of the theory of the case in the Criminal Accusatory System implemented in Mexico.

One of the specialists in the subject, Isabel Maldonado proposes the creation of a technical and scientific police because they are the first contact, the most important subject to clarify a crime also raises the need for the federal entities to implement Units of Police Officers Experienced not only in the preservation of the scene or place of investigation, but also in the processing of indications applying the Criminalistic Science. Legislation adjetivas penales in force that at the moment have implemented the new Criminal Justice System like Guanajuato, Yucatán and Tamaulipas are contemplating the creation of the Authorized Police Units. Currently the proposal of the Single Criminal Procedure Legislation raises the assignment of these police units.
